New Ontario Employment Standards poster must be given to each employee

The Ontario Ministry of Labour requires employers to inform employees about their rights under the Employment Standards Act (the "ESA").

The new version six ESA poster for Ontario must be delivered to all existing employees individually no later than June 19 and must be provided to all new hires on a go-forward basis within 30 days of hire.

Please note, it is no longer sufficient to simply post it on a bulletin board. It must be personally delivered. The Employment Standards Office says that it may be delivered electronically through email as a pdf or hyperlink so long as the employee has the ability to print the poster.

There is no requirement to receive an acknowledgment from the employee; however, the employer will, if ever challenged, have to prove compliance.
