Paul J. Stein, KC

Paul Stein is a partner in Gowling WLG's Calgary office. He practises in the area of commercial litigation with an emphasis on complex fire, oilfield, directors and officers, professional liability, environmental, product liability, employment liability, aviation, property and industrial claims, coverage litigation, class actions, construction, commercial and shareholder disputes. With over 35 years at the bar, he is deeply committed to adding value to clients' matters by providing insightful analysis of issues, timely advice and obtaining favourable results in the most efficient manner possible.

Paul has significant trial experience and has appeared before all levels of court in Alberta, various administrative tribunals and conducted matters in British Columbia, Saskatchewan, Manitoba and Ontario. He has also acted as monitoring and instructing counsel regarding commercial and coverage litigation in the United States. He has extensive experience as counsel in mediations and arbitrations.

Paul was the leader of the firm's Insurance and Professional Liability Group from 2007 to 2010.

Paul was appointed Queen's Counsel (now "King's Counsel") in 2014 and has been consistently recognized by Lexpert and Best Lawyers in Canada.

Throughout his career, Paul has served as a panellist and speaker at numerous conferences and seminars on topics relating to his preferred areas of practice. Paul has significant insurance regulatory experience, and served as a Panel Chair on the Insurance Councils Appeal Board of Alberta, an administrative appeal body created under the Insurance Act of Alberta, dealing with insurance regulatory issues.

Representative Work

Property and Casualty Claims

  • Defend individual and corporate insureds in respect of claims against them and represent subrogating insurers in actions for recovery of indemnified losses arising from fires, accidents, construction site events, oilfield incidents and environmental damages.

Energy-Related Claims

  • Evaluate coverage issues and represent insurers in actions contesting coverage regarding incidents involving pipeline ruptures, production losses, facilities fires and other energy-related losses.
  • Defend individual and corporate insureds in respect of energy-related claims on behalf of foreign and domestic insurers.
  • Represent energy companies in Alberta in respect of oilfield incidents involving gas plants, pipelines, production facilities, drilling operations and well head production testing.
  • Provide advice to energy companies regarding structuring of agreements with third-parties as to risk allocation and insurance requirements.

Product Liability

  • Defend manufacturers, distributors and vendors regarding claims pertaining to a broad spectrum of consumer and industrial products.

Professional Indemnity

  • Retained by underwriters to defend engineers, architects, insurance agents and other professionals in respect to claims asserting professional negligence against them.

Directors and Officers

  • Retained directly by directors and officers to defend them and provide strategic advice in respect of existing and potential claims.
  • Retained by insurers to defend directors and officers in claims alleging breach of duty, misappropriation and misrepresentation in financial statements and other instruments.

Coverage Advice and Litigation

  • Extensive experience in providing coverage opinions regarding all classes of coverage.
  • Extensive experience in coverage litigation regarding different classes of insurance and multiple jurisdictions in Canada and the United States including disputes among towers of coverage.
  • Previously retained to instruct other counsel in coverage litigation in the United States on behalf of foreign and domestic insurers.
