• Advancing and defending construction claims on behalf of owners and contractors, including lien, holdback, breach of trust, and surety-related claims, through negotiation, mediation, adjudication, arbitration, and court proceedings.
• Advising owners and contractors on procurement strategies and processes, and drafting, reviewing, and negotiating construction agreements, including prime contracts, subcontracts, and agreements for building construction and renovation projects.
• Acting for owners and contractors on major infrastructure projects, including light rail transit, marine works, and road construction, including projects delivered under public-private partnership models with Project Co., in the prevention, management, and resolution of claims involving delay, design errors, scope gaps, and cost overruns.
• Representing stakeholders on the development and construction of manufacturing facilities across a range of industries, including automotive, cannabis, food production, windows and doors, and chemical processing, in disputes and project advisory mandates involving delay, design deficiencies, and performance issues.
• Representing major Canadian contractors on complex claims relating to large and prominent building projects in Ontario, across Canada, and internationally, including disputes involving delay, design deficiencies, and scope gaps, on projects such as sports and recreation facilities, historic buildings, embassies, places of worship including mosques, and educational institutions including schools and post-secondary facilities.
• Acting for owners and contractors in claims for and against design consultants arising from errors and omissions in the design of complex projects, including aviation facilities, hospitals, and military installations, often involving resulting delay and coordination impacts.
• Acting for insurers in subrogated claims to recover losses arising from significant construction failures and incidents, pursuing responsible parties including contractors, subcontractors, and design professionals.
• Acting for owners, contractors, and sureties in claims for and against bonding and surety companies, including performance bond and labour and material payment bond disputes.
• Acting on complex construction matters across a broad range of projects, including residential construction, involving intertwined technical, contractual, and scheduling issues.
