As personal data becomes increasingly valuable, questions are being raised about what happens to genetic information when companies like 23andMe consider selling all or part of their business. Speaking with CBC's Your World Tonight and The National, Brent Arnold, a partner in Gowling WLG's Cyber Security & Data Protection Group, explored the privacy implications tied to the sale of sensitive consumer data.

Brent's commentary aired on March 25 and addressed the limited protections available to consumers when it comes to the resale of genetic information—especially in cases where companies update their privacy policies in advance of a transaction.

"There's nothing that would stop them [23andMe] from selling this data as part of the sale of the overall business. That is not going to require consent or notice to the individual," explained Arnold.
