Louis A. Frapporti

Louis Frapporti is managing partner of Gowling WLG's Hamilton office. His practice covers a wide range of areas, including product liability and insurance litigation, negligence and other tort actions, contractual disputes, and appellate advocacy. Following his call to the bar in 1992, he served a two-year appointment as a clerk to the Chief Justice of Ontario.

As well as serving as Hamilton managing partner and in addition to his role as an advocate, Louis has occupied a number of other management and administrative positions within the firm, including chair of the Commercial Litigation National Practice Group and head of Hamilton's Advocacy Department. He is also a member of the firm's Insurance and Product Liability National Practice Group.

Louis has been recognized by his peers as an outstanding mentor and has been a frequent lecturer on a wide range of advocacy-related subjects as well as on the topic of records management and e-discovery.

Commercial litigation & insurance defence

The focus of Louis' practice has been representing Canadian, U.S., European and Chinese corporations, particularly manufacturers and insurers, in the defence or prosecution of product liability, negligence and/or breach of contract claims. He is often consulted by his clients in relation to the negotiation of supply and service agreements with a view to mitigating legal exposure and risk. 

Louis possesses considerable courtroom experience, having tried a wide variety of cases in courtrooms across Ontario. While he is committed to the resolution of disputes on commercially sensible terms, he is firmly of the view that some matters require a trial — and that excellence in trial and appellate advocacy are essential to effective client service.

Innovative service delivery

Louis has invested a considerable amount of time into pioneering new and innovative methods of service delivery involving knowledge management tools, customized software, new staffing and billing models. These efforts are primarily centred upon insurance defence and subrogated recovery and are geared towards the handling of larger volumes of claims, primarily for insurers, at lower cost to clients. Louis was the founder and long time editor of Butterworth Canada’s nationally distributed periodical the Commercial Litigation Review and the chair of its annual national conference on commercial litigation.

  • The defence of a European manufacturer of electrical switchgear which was alleged to have failed in connection with an explosion and subsequent fire in a metropolitan shopping mall.
  • The defence of a European manufacturer of power distribution equipment which was alleged to have been defective, causing significant consequential damages to a major New York State utility.
  • The prosecution of a claim by a European manufacture of electrical power turbines seeking to recover millions owing under a contract of supply.
  • The defence of a prominent Canadian University in relation to a sizeable claim for compensation arising from the operation of its nuclear reactor.
  • The obtaining of an interlocutory and permanent injunction on behalf of the City of Hamilton enjoining protestors from obstructing the construction of a major metropolitan highway.
