Mark Ferbers

Mark Ferbers is a partner in Gowling WLG's Vancouver office. Mark has broad practice experience in real estate and business law, including construction and real estate development, financing and commercial leasing.

Over the years, a significant portion of Mark's practice has been focused on real estate development and construction-related litigation, including negotiating and drafting construction contracts, advising on mixed-use development matters including risk identification and mitigation, foreclosures and builder's liens.

Mark's litigation experience has provided him a wide range of knowledge and experience well suited to dealing with complex real estate and business issues, including distress acquisitions and project structuring. Mark has represented owners, contractors, lenders and sureties in disputes arising from real estate development and construction projects in the Supreme Court of British Columbia, Court of Appeal, Federal Court of Canada and various tribunals.

Prior to joining Gowling WLG, Mark gained a considerable experience with the legal department of Great West Life Assurance Co. in Winnipeg. He was also a partner in a boutique Vancouver real estate firm, where he worked for 14 years before joining Gowling WLG.

Mark is a member of the Canadian Bar Association and is an active outdoor sporting participant in skiing, hiking and mountain biking.

Representative Work

  • Acted for owner/developers to complete multiple construction contacts for complex large mixed use commercial/residential development projects, and advised clients throughout the construction phase on construction issues including workplace safety compliance, ancillary contracts and subcontracts and builder's liens.
  • Completed several high profile resort/hospitality property acquisitions within British Columbia including the Okanagan, Vancouver Island and the Kootenay's, inclusive of marina and water lease developments.
  • Planned with clients, litigated and assisted clients through strategic distress property acquisitions.
  • Advised and assisted clients with sales of, as well as acquisitions through to development, construction and completion of, multiple commercial real estate transactions involving apartment buildings, hotels, shopping malls, golf courses, and residential/commercial development sites.
