Gowling WLG awarded for cartel defence

The award relates to the team's work defending Thai Airways alongside the legal representatives for the other co-defendants in the air cargo cartel damages proceedings currently before the High Court.

While the main proceedings are still ongoing, in October 2017 the High Court gave a judgment on a preliminary issue, the outcome of which significantly restricted the temporal scope of the claimants' claims in the damages actions. This followed on from a successful challenge before the Court of Appeal which considered the unwarranted disclosure of material which airlines had not had the opportunity to challenge before the European Court of Justice and raised important questions as to the principle of the presumption of innocence; and a successful rejection of the claims for unlawful means conspiracy and unlawful interference with the claimants' businesses.
