Andrew Nugent Smith

Andrew Nugent Smith helps clients to resolve their commercial disputes in an efficient and commercially pragmatic way, avoiding litigation where possible. Any dispute can be hugely distracting and costly for a business or individual in terms of management time, opportunity cost and in legal spend. Andrew therefore focuses on obtaining the best possible outcome for minimum fuss. Of course, there are some cases that have to be fought and Andrew also has considerable experience of taking large cases to trial.

Andrew has a wide variety of clients, ranging from SMEs and owner managed businesses to large corporates and government bodies. He advises on all types of commercial litigation, arbitration and mediation including breach of contract and negligence claims and shareholder and corporate disputes. Andrew has a particular specialism in the automotive and aerospace sectors and has a large US client base.

Andrew also takes an interest in the ever-developing world of litigation funding and regularly advises on and acts for clients under alternative funding arrangements.

Outside of the office, Andrew is a keen amateur triathlete and cross country runner.


  • Successfully defending tier 1 automotive supplier TRW Automotive in claims against it for in excess of €35 million brought by a supplier for the alleged breach of an exclusive supply agreement. This factually and legally complex case was a truly international dispute, requiring witnesses and evidence from the UK, the US, France, Germany, Spain, Portugal and Singapore.
  • Pursuing claims valued at over £150 million for a leading Belgian Bank against a Big 4 accountancy firm for losses arising out of a failure to detect fraud in a UK asset finance subsidiary. By taking a co-operative approach with the defendant accountants, we were able to agree a sizeable financial settlement without the need to issue proceedings.
  • Defending claims against a Far Eastern sovereign wealth fund arising out of its potential liabilities under funding arrangements entered into in respect of its prior participation in the RBS Rights Issue Litigation
  • Pursuing claims for the UK's five largest brewers valued at over £90 million against the perpetrators of large scale and systematic keg theft that was costing the brewing industry millions of pounds a year. Although the case settled before trial, it has led to a noticeable decline in keg theft
  • Advising OCCAR, the pan-European defence procurement agency, on issues arising out of the €20 billion plus, 180 aircraft A400M military transporter programme. This included advising on a significant amendment to the contract in 2010 and further ongoing issues.
  • Pursing a multi-million pound professional negligence claim by the vendor of a travel agency business against its former solicitors arising out of the negligent drafting of a side agreement relating to the transaction.
  • Defending the vendors of an aeronautical components manufacturing business in respect of warranty claims brought against them valued at £40m following the sale of the business.
  • Advising the legal owner of a 1963 Ferrari 250 GTO valued at over $50m in respect of a dispute over its ownership (involving proceedings in the UK, Singapore, California and Texas).
