Elinor Crowther

Elinor has specialised in international disputes (particularly arbitration) and dispute avoidance for 15 years. Elinor advises both owners and contractors, in connection with major and complex international energy, infrastructure and construction projects around the world, including in the Middle East, Africa, Asia, Europe, and Sri Lanka. Elinor holds a Master's degree in construction law and arbitration.

Elinor's international arbitration work involves dealing with all stages of the proceedings, from initiation to enforcement of the final award. Elinor has acted in international arbitrations arising out of projects in Taiwan, Saudi Arabia, Qatar, Tajikistan, Côte d'Ivoire, the USA, Germany, and Sri Lanka. Elinor also has significant experience in settling disputes through alternative forms of dispute resolution, including mediation.

Elinor's dispute avoidance work involves acting as project counsel during the execution phase of a project, managing live risks as part of the client's team, providing advice in real-time as events occur, drafting key correspondence and assisting with the resolution of disputes at project level, including by dispute (adjudication) boards. Elinor has carried out this role on projects in North America, the Middle East, and Sri Lanka.

International Arbitration Experience

  • ICC arbitration on behalf of a major European engineering company in relation to a mass rapid transit system in Taiwan under bespoke Conditions of Contract. Seat of arbitration Singapore and subject to Republic of China law.
  • ICC arbitration on behalf of a contractor in relation to the construction of a road project in Sri Lanka under FIDIC Conditions of Contract. Seat of arbitration Colombo and subject to Sri Lankan law.
  • LMAA arbitration on behalf of a German boatyard in relation to the construction of a superyacht under bespoke Conditions of Contract. Seat of arbitration London and subject to English law.
  • LCIA arbitration on behalf of an international drilling contractor in relation to a drilling contract offshore the Ivory Coast. Seat of arbitration London and subject to English law. Dispute ultimately settled by mediation.
  • ICC arbitration on behalf of a Saudi Arabian contractor in relation to the construction of a power project in Saudi Arabia under bespoke EPC Conditions of Contract. Seat of arbitration Jeddah and subject to Saudi Arabian law.
  • ICC arbitration on behalf of a private sector development organisation in relation to a hotel development in Tajikistan under the FIDIC Conditions of Contract. Seat of arbitration London and subject to English Law. Dispute ultimately settled by mediation.

Project Level Dispute Resolution and Project Counsel Experience

  • Advising a Dubai government-linked master developer in a series of contractual adjudications in relation to construction claims and disputes arising out of four hotel developments in Dubai.
  • Advising a multinational consortium of a major multi-train LNG facility in North America on a number of contractual and legal issues during the execution phase of the project, including in relation to the interpretation of contractual provisions and EPC contractor claims arising out the impact of COVID-19 on its global supply chains.
  • Advising a consortium, including state entities and energy majors, on potential claims arising during the execution phase of a number of projects relating to the development of large scale liquefaction and export facilities in Qatar and a UK re-gasification terminal.
  • Advising a contractor on legal and contractual issues and risk management in relation to number of infrastructure projects in Sri Lanka.
