Emma Hipkiss is an Associate in our Real Estate group.

She has wide-ranging real estate experience, advising and acting for registered providers of social housing (both not-for-profit and for-profit) and institutional investors within the social and affordable housing sector. Emma guides and advises her clients on land acquisition for development on an unconditional or conditional basis, section 106 unit acquisitions on a golden brick and turn-key basis and bulk acquisition of investment property portfolios. She is always looking for ways to streamline delivery of services to maximise efficiency.

Emma's clients include Legal & General Affordable Homes, Sanctuary Group, Bournville Village Trust, Barnardo's, Fox Hound Capital and RCM Neo.

Experience

Advising Bournville Village Trust on various aspects of its delivery of new village communities at Lightmoor and Lawley, Telford in joint venture with Homes England. This included estate management, open space transfers, commercial leases of community space and ad hoc operational advice.
Providing a national children's charity with legal due diligence support on a project to deliver affordable homes for young people leaving care (on a pro bono basis).
Working as part of the Fox Hound Capital team on the bulk acquisition of portfolios of residential properties to be converted for use as homelessness accommodation. This included preparation of a bespoke form of title certificate which streamlined the subsequent debt raise process.
Working with Sanctuary Group on the delivery of its development programme, including acquisition, funding, planning and infrastructure. For example, Emma acted for Sanctuary on a sub-sale agreement to acquire land at Dartmouth on a conditional basis for the construction of a care home.
Advising Legal & General Affordable Homes in relation to a wide range of development matters (both land-led, s106 and open market acquisitions at turnkey or golden brick stage). For example:
- carrying out the legal due diligence on the bulk acquisition of market housing from a major house builder for onward shared ownership sale;
- negotiating the c.£15 million acquisition of turnkey units under considerable time pressure; and
- devising a streamlined process for the delivery of ongoing golden brick and turnkey completions.
