Jin Yan is a trademark attorney who has practised in the field of intellectual property prosecution since 2009. Jin focuses her practice in contentious and non-contentious trademark prosecution matters, including but not limited to trademark portfolio management, trademark clearance searches, reviews of refusal, oppositions, cancellations, invalidations and negotiations for assignment as well as for trademark co-existence. She is also experienced in copyright registration, customs recordals and online trademark enforcement.

Having represented both Fortune 500 companies and small-sized enterprises, she always realizes great responsibility for the clients, and tries to put herself in the client’s shoes to better understand what they need and to provide them with the most practical and feasible solutions.

Recent Experience:

  • Successfully opposed pre-emptive filings for a German skincare brand, which did not enter into China before the filing dates of the pre-emptive filings, and having the China National Intellectual Property Administration recognized the certain fame of the German brand in its decisions.
  • Successfully obtained a Letter of Consent from a Chinese company to help pursue the trademark of a European construction equipment manufacturer in litigation.
  • Advised and represented a US entertainment equipment company in negotiations with a Chinese leading intelligent software company for trademark co-existence.
  • Provided a successful strategy for the registration of a German construction equipment manufacturer’s trademarks after they were refused as lacking distinctiveness and with the citation of a number of prior marks.
  • Liaised with the Chinese Embassies in various countries for the “Green Channel” of legalization of the documents required in litigation, which was delayed by COVID-19.
  • Successfully had the Supreme Court accept the petition for retrial of the second instance judgement on a trademark case.
  • Handled the full trademark portfolio of several industry-leading Europeans companies.
