John R. Cusano

John Cusano is a partner in Gowling WLG's Calgary office. John practises in the areas of commercial litigation, insurance and regulatory law.

John has a large practice in the financial services sector where he specializes in both retail and commercial matters, and has worked on behalf of large financial institutions in defending against fraud, breach of contract, negligence, and other matters where litigation and subsequent financial risk are involved.

In John’s energy practice he has appeared before provincial and federal regulators with matters related to market rules applications, transmission system expansions, and cost of capital and other tariff issues. From an oil and gas regulatory perspective, John has extensive experience in contractual agreements related to surface rights, natural gas liquids, facility applications, processing service agreements, pipeline agreements and cost of service issues.

John’s experience extends to matters before various regulatory tribunals, including the Energy Resources Conservation Board, Alberta Utilities Commission, National Energy Board and the Surface Rights Board.

John has also appeared before all levels of court in Alberta, and has extensive experience in both mediation and commercial arbitration.

John has authored and delivered papers on various topics to both members of the firm and industry clients. He has also participated as a panellist and speaker on various insurance related topics.

  • Defended a large financial institution against allegations of improper conduct in its receivership actions against a defaulting commercial debtor. The Court of Appeal struck the entirety of the claim against the financial institution on the basis of collateral attack and abuse of process.
  • Defended a large financial institution with respect to a proposed class action involving an alleged Ponzi scheme.
  • Defended a large financial institution with respect to alleged fraud allegations.
  • Defended a large financial institution with respect to claims arising out of certain loan facilities.
  • Appeared before the Alberta Utilities Commission with respect to Alberta transmission expansions with a build of $400M.
  • Advised on the regulatory aspects of a $1.075B acquisition of an NEB-regulated pipeline.
