Marco Romeo

Marco Romeo is an associate in Gowling WLG's Toronto office. He practises in the firm's Advocacy Group, focusing on complex commercial litigation.

Marco's areas of practice include contract disputes, class action litigation (including product liability, securities, and competition cases), insolvency, director and officer liability, and defamation law. He has experience representing clients from the United States in disputes that have a cross-border element, as well as enforcing judgments of US courts in Canada. Marco works closely with clients to understand their goals, and develops creative and practical strategies to obtain excellent outcomes.

Marco is a graduate of Boston University School of Law. He completed his undergraduate studies at the University of North Carolina at Chapel Hill, where he was a Morehead-Cain Scholar.

Representative Work

  • Airline "Capacity" Class Actions – Defending a U.S. airline in class actions commenced in multiple jurisdictions in Canada in which plaintiffs allege that the defendant airlines conspired to limit the increase in capacity in the airline industry in order to drive higher prices and higher margins.
  • Airline "Fuel Surcharge" Class Actions – Defending a U.S. airline in class actions commenced in Ontario on behalf of all persons who purchased a ticket for trans-Atlantic or trans-Pacific air travel. The plaintiffs allege that the defendants participated in a worldwide price-fixing conspiracy in relation to fuel surcharges that were applied to airline tickets. The plaintiffs have claimed approximately $200 million in damages.
  • Barkerville Class Action – Defended Barkerville and two of its former directors and officers against a securities class action relating to alleged misrepresentations concerning geological reports issues in regard to the company&'s mining properties. The claim has been settled.
  • Colt Resources Class Action – Defended Colt Resources and two of its directors against a shareholder class action alleging that the company failed to make timely disclosure of a material change and subsequently made misrepresentations in its disclosure documents. The plaintiffs were granted leave to proceed with claims under s. 138.3 of the Securities Act, but with a much narrower scope than the plaintiffs sought in the Statement of Claim. The claim has been settled.
  • Contractual Enforcement – Represented a multi-national uniform supplier with respect to multiple cases involving enforcement of its contractual rights.
  • Coroner's Inquest – Represented a client before a jury in a coroner's inquest into the death of a worker on a construction site.
  • Home Trust Class Action - Defended Home Trust Company against a class action alleging breaches of the Consumer Protection Act and Competition Act, and civil conspiracy, relating to the Home Trust's financing of consumer HVAC equipment rentals. Opposed plaintiffs' motion for certification as a class proceeding, which was granted on a much narrower scope than the plaintiffs sought in the Statement of Claim. Successfully opposed the plaintiffs' motion for summary judgment, which was dismissed. The claim has since been settled.
  • License Appeal Tribunal – Represented a client before the License Appeal Tribunal to challenge an order suspending a motor vehicle dealer's registration.
