Max Muñoz

Max Muñoz is an associate lawyer in the Advocacy Department of Gowling WLG's Toronto office. His practice covers complex commercial matters, including class actions (primarily in the areas of securities and product liability), claims against directors/officers, and broker/dealer disputes (civil and regulatory).

Max has been successful in obtaining excellent outcomes for clients through litigation, negotiation and mediation. He has appeared before the Ontario Court of Appeal, Ontario Superior Court of Justice and Ontario Court of Justice. He also has significant experience managing large-scale documentary review and production in complex commercial cases.

In addition, Max is a frequent guest lecturer on the topic of white collar crime at the University of Windsor Faculty of Law.

Max is fluent in Spanish and French, and conversant in Italian.

Securities

  • ​Barkerville Class Action - ​Defending Barkerville and two of its former directors and officers against a securities class action relating to alleged misrepresentations concerning geological reports issues surrounding one of the company's mining properties.
  • SNC-Lavalin Class Actions - Defending the former CEO of SNC-Lavalin in class actions in Ontario and Quebec. Investors sued the company and its officers and directors for approximately $1 billion in damages under secondary market liability legislation. They allege damages caused by misrepresentations in various SNC-Lavalin public documents. The action has been certified as a class action, but with a much narrower scope than the plaintiff’s sought in the Statement of Claim. The defendants have successfully resisted two motions and an appeal by plaintiffs who seek to amend the Statement of Claim.
  • Penn West Class Actions - Defending one of the largest conventional oil and natural gas producers in Canada against shareholder class actions in Ontario, Alberta and Quebec. Shareholders sued the company and its officers and directors for approximately $500 million in losses that they claim to have suffered as a result of a restatement by Penn West of certain historical financial statements. A settlement has been reached that is subject to various conditions and the receipt of court approval.
