Nicky Yarwood

Nicky helps pension scheme employers and trustees to solve issues and problems, whether they arise from the scheme's rules, pensions legislation or other aspects of the scheme's administration.

She has been involved in a number of important reported cases in which the courts have made decisions of wider application for the pensions industry, acting on behalf of employers, trustees and members of pension schemes. Nicky has particular experience of cases which have been resolved by summary judgment or compromises approved by the court.

Nicky also has considerable experience advising clients on complaints brought under a scheme's internal dispute resolution procedure and to the Pensions Ombudsman. She also has experience of proceedings before the Determinations Panel.

Nicky is an active member of the Association of Pension Lawyers.

Experience

  • Nicky currently acts for the Trustee of the Axminster Carpets Group Retirement Benefits Plan in proceedings seeking the Court's ruling on various issues arising under the Plan's rules and the applicable law.
  • She has acted in a number of cases brought to interpret scheme documentation, including Alexander Forbes v Clarke and ITS v Knell, and an important case on scheme booklets which went to the Court of Appeal, Steria v Hutchinson.
  • Nicky has been involved in other cases in which the court rectified the scheme's rules, including Misys, Colorcon, Mondelez, Samworth, Hycalog and Filtrauto, some of which were resolved by summary judgment and others of which were compromised with the approval of the court.
