Rachael Hetherington

Rachael Hetherington is an Associate based in Gowling WLG's Commercial Litigation team in Birmingham working with a range of clients on various forms of commercial dispute resolution. She can help you identity and manage risks in order to come to a commercial resolution.

Rachael specialises in in the technology sector representing both customers and suppliers in contentious matters arising from technology contracts for the design, build, and implementation of IT systems and/or provision of IT services or Software as a Service (SaaS). She also advises clients on software licencing agreements, audits and compliance.

Rachael also focuses on data privacy matters including data breaches and the enforcement of data subject's rights under data protection legislation including complex Data Subject Access Requests, complaints raised by data subjects and data privacy litigation.

Experience

Technology and outsourcing dispute resolution

  • Advising a global IT consultancy in a multi-million pound contract dispute with a customer;
  • Working with and advising a large scale telecoms provider in relation to a settlement agreement;
  • Advising a customer in a multi-million pound litigation claim against a global IT supplier which resulted in settlement at mediation;
  • Advising clients on software licensing audits and the interpretation of software licence agreements;
  • Advising clients on risk management and change control including drafting change notes, contract variations, termination options and interpretation of limits of liability.

Data Privacy

  • Advising global companies on incident management and data breach response.
  • Acting for clients in data privacy litigation matters arising out of data breach incidents, breach of confidence and data misuse.
  • Assisting clients handle and respond to significant and complex data subject access requests including the application of exemptions from data subject access rights.
  • Advising a global retailer in relation to a complaint made by a customer relating to the use of cookies and tracking pixels in its marketing emails.
