Tom has a wide range of experience of commercial and residential real estate matters in both a contentious and advisory capacity, including:

  • Commercial landlord and tenant (break options, dilapidations, lease renewals, breach of covenant claims, service charge and rent review issues).
  • Development agreements.
  • Boundary disputes.
  • Planning enforcement.
  • Rights of way.
  • Insolvency and the property aspects of corporate restructuring.
  • Residential landlord and tenant matters, including: enfranchisement, tenant's rights of first refusal under the Landlord and Tenant Act 1987, possession and trespass. 

Tom's clients include: commercial property developers, house builders, pension funds, public sector bodies, housing associations and charities.

Tom's recent experience includes:

  • Representing a national retailer in a trespass and rights of way dispute.
  • Advising a local authority on vacant possession strategies relating to a bonded warehouse.
  • Representing a data centre operator in relation to a potential claim regarding disturbance caused by redevelopment building works.
  • Advising funds and property owners on the impact of their tenants entering into a Company Voluntary Arrangements, and the steps they can take to protect their position.
  • Advising the operators of an international airport in relation to potential forfeiture action relating to several airside hangars.
  • Part of a team advising a national house builder on the implications of mines and minerals interests across their portfolio.
  • Advising a community housing charity in relation to a historic shared ownership dispute.
  • Representing a national retailer in relation to a possession claim of residential premises situated above a commercial retail unit.
