Susannah E Fink

Susannah Fink is a London-based legal director who advises on dispute resolution. Her practice has an emphasis on general commercial litigation, although she is also specialised in insurance litigation and general insurance advice.

Susannah has developed wide-ranging dispute litigation experience, having acted for companies and company directors in the natural resources, life sciences, advertising, banking, construction and technology industries. Many of her cases involve an international element and she is used to working alongside foreign lawyers. Susannah is experienced in both High Court litigation and international arbitration. She recently enhanced her understanding of her clients' needs through a secondment at an accountancy firm.

On the insurance and reinsurance side, Susannah has represented Lloyd's Syndicates and insurance companies, based in the UK, Bermuda and the US, with a focus upon financial lines coverage disputes. She also assists policyholder clients of the firm with non-contentious insurance advice, particularly in relation to warranty & indemnity (W&I) and title indemnity policy wordings.

Susannah is head of the firm's Israel Desk.

Experience

  • Acting for an Israeli pharmaceutical company in an indemnity and breach of contract claim in the Commercial Court;
  • Advising a South African based outsourcing company in relation to a breach of warranty claim;
  • Representing an AIM listed gas exploration company in a High Court dispute, where it was being sued by a former director who had lost out on lucrative share options when he was removed from office;
  • Assisting a European bank noteholder to settle several disputes in England and the US arising out of transactions involving CDOs that had been ongoing for many years;
  • Acting for D&O insurers in respect of a case where a director was defending allegations of fraud in High Court proceedings;
  • Representing an advertising agency in a Commercial Court breach of contract and negligence claim;
  • Assisting a Bermuda based excess insurer to achieve a favourable settlement in an international arbitration relating to coverage for D&O liability;
  • Representing a group of Lloyd's Syndicate and company insurers defending a Commercial Court dispute arising out of the financing of various film productions;
  • Advising the liquidators of a group of companies in proceedings several jurisdictions to recover losses arising out of fraud committed by its directors;
  • Assisting a computer games publisher to achieve a beneficial settlement of a claim for breach of contract made by a distributor.
  • Susannah has experience of judicial review and has represented clients faced with challenges in procurement judicial review challenges including the drafting of pleadings.
