Construction & Engineering

Our "large and impressive" team of experts is ranked as a national leader in Chambers UK 2014. Combining quality and skill to provide a first-class service, clients praise our "background knowledge, speed of reaction, and accuracy of advice". (Chambers UK 2014).

Representing major contractors and leading developers, we enjoy strong and longstanding relationships with some of the sector's most significant players. Our enviable client base also includes employers, funds and end-users.

These clients benefit from our:

  • Commercial nous - technical excellence is a given, but with backgrounds in the construction industry - including former chartered surveyors - we also provide a commercial approach
  • Sector knowledge - with many years' combined experience, we have in-depth knowledge of all the major standard forms of industry contracts, as well as the ability to draft and negotiate bespoke documentation
  • Cradle-to-grave expertise - specialist advice at every stage of the development process - from project conception and choice of procurement, through to the tender process, complex contractual negotiations, contract management, dispute avoidance and resolution

First-rate contentious construction expertise

Taking a lead role in some of the industry's biggest disputes, we are active in the courts and respected by the judges and leading specialist chambers.

A track record in all forms of dispute resolution including mediation, adjudication, conciliation, litigation and arbitration, means clients are in safe hands. It's why we can frequently be found advising big-name companies on big-ticket cases.

Experience includes advising one of the UK's largest electric utility service providers on parallel sets of High Court proceedings relating to multi-million pound claims. A major UK civil engineering contractor has also turned to us to advise on disputes arising from the design and construction of a landmark road scheme in central England. We are helping to protect its position and interpret its factual situation in the highly complex, bespoke contract.

Further afield, we have significant experience of resolving construction disputes in the Middle East, where projects range from a major Dubai shopping mall to a specialist installation at the New Doha International Airport in Qatar.

Track record in non-contentious construction

Ranked as a stand-alone first tier firm by Legal 500, we also boast leading non-contentious construction expertise. Our sector specialists can frequently be found advising on multi-million pound projects.

Understanding that time, quality and cost are the three main drivers in any construction project, we ensure that the most appropriate procurement route and contract is chosen.

Our proven track record in big-value deals includes advising on the construction law elements of the £2 billion New Covent Garden Market redevelopment and a trio of contracts for St. Modwen's £450 million science campus development at Swansea University.

The UK has seen an upsurge of major companies investing in automated warehouses and distribution centres. The team's first-rate CV in this area - having advised a number of household names - has earned its recognition as leading experts in the market. Experience includes advising one of the UK's biggest retailers on complex multi-million pound mechanical handling equipment contracts, together with related professional appointments and fit-out contracts.

Thought leaders

Committee members of the Technology and Construction Solicitors' Association (TeCSA), team members are also actively involved in other bodies such as the Chartered Institute of Arbitrators, the Royal Institute of Chartered Surveyors and the Society of Construction Law. This involvement with leading sector bodies, as well as regular contributions to the key professional publications, means we are thought leaders on the latest issues.

Clients include AMEC, AXA, Black & Veatch, Bloor Homes, Cemex, Development Securities, E.ON, Girl's Day Schools Trust, Legal and General, London Borough of Croydon, Kier May Gurney, Miller, Morgan Sindall, Persimmon, Pochin Construction, Prologis Developments, Royal London Asset Management, Shepherd Group, St. Modwen Properties, Waitrose/John Lewis and Wates.

Experience

Innovative contract solution for major developer

Our non-contentious construction specialists advised a national developer on one of the first new shopping centre developments to be built since the recession.

A large-scale development, it involves numerous third-party agreements, property documents and development agreements. These all had to be 'backed off' into the construction contracts.

We helped the client to get into contract quickly with the contractor. The contract is unusual as it is a guaranteed maximum price contract involving an innovative costs share mechanism, which incentivises the contractor to stick to budget.

First 'new build' luxury hotel in London for more than 40 years

Bulgari Hotels & Residences owner, Prime Knightsbridge Developments Limited, called upon the team for a 'cradle-to-grave' service. Our experts advised on the development, structuring, procurement, construction, letting and sale of the residences, penthouse apartments and the hotel element. Providing specialist construction advice in relation to procurement strategy and on the commercial options available, we helped the client to achieve project completion on time and on budget.

Bicester town centre redevelopment

Undertaking a growing amount of work for J Sainsbury's, successes include advising on the redevelopment of Bicester town centre in partnership with the local authority to provide a £70 million mixed-use scheme. We helped the project reach practical completion through expert negotiation with third parties - acquiring and varying third party rights to give the development the green light.

Energy and Infrastructure

We also have particular expertise in advising on complex high-value construction projects in the energy, natural resources and infrastructure sectors. Our experts work with developers and their lenders and the supply chain on projects in the UK, Africa and the Middle East.

Partner Paul Green advised Mercia Waste Management Limited on a £195 million energy-from-waste facility in the UK and partner Jonathan Brufal advised Urundul Energy on the EPC contract, O&M Agreement and LTSA for a merchant 600 MW CCGT project in Turkey.
