The value of your data and how to protect it: Brent Arnold discusses liability in data breaches on CBC's Just Asking
Speaking recently with CBC Radio's Just Asking, Brent Arnold, a partner in Gowling WLG's Cyber Security & Data Protection Group, shared his perspective on data breaches and the legal challenges of holding companies accountable when personal information is compromised. The segment, titled "The value of your data and how to protect it," explored the risks associated with sharing personal information online and the potential consequences of major data breaches.
Reflecting on how Canadian courts approach corporate responsibility in these cases, Brent explained:
"The courts have recognized that the fact that a breach happens doesn't necessarily mean the company was negligent. They could have done everything reasonable but still been hacked. What matters is whether they had a commercially reasonable level of security in place."
