Bio

Manpreet (Manny) Kandola is a Principal Associate in the Construction and Engineering Disputes team. She has over six years' experience, dealing with all major forms of construction and engineering contracts, such as NEC, JCT, and FIDIC, as well as bespoke contracts and associated transaction documents.

Manny has acted for developer, contractor and sub-contractor clients, in all forms of dispute resolution – litigation, arbitration, adjudication and mediation. Her sector experience spans commercial and residential real estate, as well as energy.

She regularly advises on arrange of matters including defects, professional negligence, breaches of contract, variations, extensions of time, loss and expense, payment obligations, set-off, and termination, construction-related advice in the event of an insolvency.

Manny is committed to giving strategic advice to clients to ensure disputes are resolved efficiently and with the best possible outcome.

Expérience

Acting for an employer client on a final account adjudication under an NEC3 Option A contract.
Advising a developer client in the nuclear sector, on termination of various NEC3 Short Form contracts.
Advising a developer client in the nuclear sector, on a contractor insolvency under a NEC3 ECC contract, including termination notices and project manager's assessment on termination and steps to preserve the client's common law rights.
Acting for a contractor client in an arbitration relating to the construction of aviation fuel storage tanks at the one of the largest inland oil depots in the UK, under an NEC3 Option C contract.
Advising a global engineering and construction company on securing an injunction in the courts of England and Wales in relation to a bond under an EPC contract, on €1.5 billion project in Poland.
Acting for a contractor client in the Technology and Construction Court, regarding a dispute with the employer as to the allocation of risk for existing structures, successfully securing a judgment in favour of her client.
Advising a developer client on termination for contactor insolvency, in relation to JCT Design and Build contract, including step-in rights, and navigating risk of a claim from liquidators.
Acting for developer and contractor clients in respect of claims for fire safety defects, as well as advising on aspects of the Building Safety Act.
Acting for a developer client on a variety of disputes relating to a multi-million-pound development in central London, including payment provisions, retention of title, collateral warranties and third-party agreements. The disputes also include two separate adjudications brought by a contractor relating to a number of variations, extensions of time and loss and expense.
