Nick Harding

Nick Harding is an associate in the London office of Gowling WLG, specialising in planning and environmental law. Nick has several years of experience advising clients on a wide range of planning, highways and environmental law, including negotiating planning and highways agreements, advising clients in relation to Compulsory Purchase Orders, defending and bringing judicial challenges and advising clients regarding new infrastructure developments and commercial real estate acquisitions.

Nick's experience stretches across many sectors including energy and infrastructure, housebuilding and retail. This wide range has allowed Nick to see transactions from many different angles and views and to appreciate that different projects necessitate a different approach to be taken to be able to understand a client's business and be their trusted advisor.

Nick's clients include housebuilders, developers, local authorities, investors and pension funds.

Experience

  • Successfully advised Ineos, a multinational chemicals company, on obtaining a Development Consent Order (DCO) for the construction of an underground gas storage project in Cheshire, classified as a Nationally Significant Infrastructure Project (NSIP).
  • Represented a national recycling company in the High Court in challenging the decision of the Secretary of State for Communities and Local Government to refuse planning permission for various improvements to an operational waste transfer facility in Surrey.
  • Involved in the legal team which successfully negotiated a planning agreement on behalf of a US-based real estate company to obtain planning permission for 2,750 new homes and schools, a new business park, a new train station and community, retail and leisure uses on land north of Horsham, West Sussex.
  • Advised a start-up company on the various environmental permits needed to operate an innovative form of renewable energy known as pyrolysis, including advising the company on project finance.
  • Advised the owners of a marina on the River Thames, whose land was the subject of a proposed Compulsory Purchase Order (CPO). Nick drafted objections to the proposed CPO on behalf of the client and negotiated a settlement agreement with the promoters of the CPO scheme in Brentford.
