Scott E. Foster
Scott Foster is a partner and leader of the Intellectual Property Litigation Group in the Vancouver office of Gowling WLG. His practice focuses on contentious IP in the fields of trademarks, patents, trade secrets/confidential information, copyright, industrial designs, privacy disputes and domain name disputes.
Scott is an expert on IP laws and practice, with over 16 years of experience in the United Kingdom and Canada. Scott has been named: a "Litigation Star" for intellectual property by Benchmark Canada; in Who's Who Legal: Patents; an expert in both Intellectual Property and Intellectual Property Litigation in the Canadian legal Lexpert directory; and an expert in Intellectual Property Law in The Best Lawyers in Canada.
Scott has successfully represented clients in both the federal and provincial courts in trademark, copyright, industrial design, patent, trade secret/confidential information, defamation and IP licensing cases. A particular focus of Scott's practice is interlocutory relief, including injunctions and seizure orders in respect of counterfeit products and misappropriated confidential information. Scott has also represented clients in arbitrations and mediations in respect of IP and licensing disputes.
Scott has also successfully represented clients on cross-border disputes, including multi-jurisdictional enforcement programs, applications in respect of Letters of Request/Letters Rogatory, enforcement of non-Canadian judgments in Canada, and challenges to jurisdiction under private international law.
Scott is an active member of INTA's Enforcement Committee, IPIC's Anti-Counterfeiting Committee, Life Science BC's Health Regulatory Committee and the Young International Arbitration Group.
