Bio

Josh acts for employers, trustees and representative beneficiaries to help them resolve a wide range of issues relating to occupational pension schemes, including rectification, release of surplus, equalisation and related professional negligence claims.

He also advises on responses to member complaints under schemes' internal dispute resolution procedures and to the Pensions Ombudsman, with a particular expertise in relation to transfer complaints and pension sharing orders. He provides clear advice and ensures that complaints are dealt with in a proportionate way.

Josh is an active member of the Association of Pension Lawyers.

Experience

Josh acts for a Representative Beneficiary in a claim being brought by the principal employer of a pension scheme to rectify three deeds and any subsequent hearing on the interpretation of the scheme rules governing male and female normal retirement ages.
Josh acts for the Trustee in intended Part 8 proceedings to determine whether the closure of a charity's scheme was effective.
Josh is acting for a Trustee in proceedings to be brought in relation to issues identified with the validity of the scheme's closure, equalisation of normal retirement dates, changes to the amendment power and other execution issues.
Josh is acting for a Trustee in proceedings to be brought for relief in relation to issues identified with the scheme's legal documentation on normal retirement ages, pension increases and forfeiture.
Josh acted for Virgin Media Limited in the Court of Appeal hearing involving section 37 of the Pension Schemes Act 1993.
Josh acted for a Representative Beneficiary in Part 8 proceedings brought by the trustee of a pension scheme that involved the novel use of section 57 of the Trustee Act 1925 to give the trustee the power to change the composition of its board.
Josh acts on behalf of local authority clients in relation to exit credits payable to employers including in circumstances when a significant surplus has arisen or on the termination of a joint venture agreement.
Josh acts for the London Borough of Croydon in proceedings seeking the recovery of funding contributions in its capacity as the administering authority of the London Borough of Croydon Pension Fund.
Josh acted for the Trustee of the Mitchells & Butlers Pension Plan in proceedings seeking rectification of historic deeds purporting to grant the employer the power to change the rate by which pensions are increased and deferred pensions revalued under that scheme. He also acted for the Trustee in related Beddoe proceedings.
