Insights on Alberta courts tightening timelines on lien claims: Gowling WLG in Law360 Canada
In a recent article for Law360 Canada, Tom Brookes, Madelaine Desaulniers, and Mischa Longman of Gowling WLG's Calgary office provide expert insight into the Alberta Court of King's Bench decision in 1951789 Alberta Ltd. v. Britannia Block General Partnership Inc. The authors explore how this ruling may signal a shift in how Alberta courts enforce deadlines under the Prompt Payment and Construction Lien Act (PPCLA).
Published on August 18, the article explains that Alberta's lien legislation imposes stricter timelines than those in other provinces, and that lien claimants must now be prepared to move promptly through litigation—or risk losing the security lien protection provides.
The authors note that the 1951789 Alberta Ltd. v. Britannia decision may be relied on to encourage courts to enforce section 46 of the PPCLA more readily and dismiss lien claims that do not proceed expeditiously.
