Acting for a distressed lender on negotiating and implementing a consensual debt restructuring of circa £500m across a 22 corporate borrower group with a managed agreement on the sale of secured assets, such as commercial property, hotels, care homes, pubs, holiday parks and residential, across the UK and Europe. All parties looked to lose out on a formal insolvency, and this was avoided by skilful negotiation with an eye to the commercial realities.
Acting for investors with a distressed portfolio of shopping centre assets; advising on contingency planning and security enhancement, which ended up being bespoke to the centres, but which ultimately helped to maximise performance and thereby improve the position of both parties.
