Josée Gervais is a partner in Gowling WLG's Montréal office. Josée is the leader of the employment and labour group in Montréal. She advises, represents and counsels unionized and non-unionized employers, whether provincially or federally regulated, on all aspects of employment and labour law, including the drafting of employment contracts (including termination and restrictive covenants), the creation and implementation of employment policies and procedures (hours of work, vacation, statutory leaves and holidays, performance and disciplinary management, drug and alcohol testing, criminal background checks, employment termination), and the negotiation and interpretation of collective agreements.
In addition, Josée advises and assists employers in the areas of occupational health and safety, pay equity, human rights, and labour relations, as well as the application of labour standards. Josée also represents employers before the civil courts and before various administrative tribunals, such as the Commission des relations du travail (Québec labour board) and the Commission des lésions professionnelles (Québec workers compensation board).
She has also developed expertise in the application of provincial privacy legislation in relation to employment matters, counselling employers on their duties regarding privacy protection, background checks, employee monitoring and surveillance, consents and acknowledgments for the collection, use and disclosure of personal information, and transfer of data to third parties. Josée also represents public and private sector employers in collective bargaining.
Before beginning her studies in law, Josée studied and worked in the field of journalism. During law school, she won several awards in recognition of her academic excellence.
