Bio

David Wigy works with clients to resolve disputes, conclude deals and protect their rights, in a timely and cost-effective manner.

David acts on a wide range of real estate matters, both contentious and advisory. This includes lease renewals (uncontested and hostile), exercise of break rights, possession proceedings, adverse possession claims, service charge disputes, insolvency matters and planning injunctions.

He also advises on vacant possession strategies, and complex tenants' rights of first refusal issues under the Landlord and Tenant Act 1987.

David's clients include investment funds, property developers, high street retailers, major UK housebuilders and public sector organisations.

Expérience

Acting for a global engineering company to successfully enforce obligations on the purchaser of one of its properties to remediate the site and surrender an environmental permit relating to it, despite the purchaser having entered LPA receivership.
Defending a major housebuilder in High Court injunction proceedings relating to alleged breaches of planning obligations.
Advising a developer client on a vacant possession strategy for office premises which were to be redeveloped as commercial property, obtaining vacant possession in the necessary timescale and demonstrating that the tenant's entitlement to statutory compensation was lower than claimed.
Advising various clients on complex tenants' rights of first refusal issues under the Landlord and Tenant Act 1987. This has included:
- acting for a developer client where a public body requested a transfer of land forming part of a residential development for infrastructure works, and
- acting for a major UK company to identify and mitigate rights of first refusal issues in a proposed group reorganisation.
Advising an investment fund on recovering possession of commercial premises that had been used for criminal activity and had been closed by the Police.
Assisting on proceedings in the High Court and Court of Appeal between a number of public bodies in relation to the extent of highways land to be transferred to them under secondary legislation.
