In a precedent-setting decision this past November, the Supreme Court of Canada found the City of Sudbury liable for a fatal incident caused by the employee of a company that the city had hired to fix a water main. The decision, which greatly expands the health and safety obligations of an "Owner" under Ontario's Occupational Health and Safety Act, has significant implications for Canada's construction sector.
