Condo regulator’s attempt to connect with owners raises privacy concerns: Rodrigue Escayola quoted in the Globe & Mail
In a recent Globe & Mail interview, Rodrigue Escayola offered his perspective on efforts made by the Condominium Authority of Ontario (CAO) to collect owner contact information from condo managers.
In the latest version of its mandatory annual filing form, the CAO had asked managers to check a “Yes” or “No” box to indicate whether they would like to be contacted by the CAO to “discuss how [they] might connect” with owners – a move that has raised privacy concerns among managers and condo law experts alike.
“It would be improper, in my view, for managers to provide any personal data, including email addresses, to the CAO,” said Rod. “Unless and until regulation is changed to authorize such disclosure. Owners’ email information is obtained by managers for purposes set out in the Condominium Act – not to become the CAO’s marketing trampoline.”
