Ana Lelliott

Ana conducts a wide range of corporate and commercial disputes. She has experience of acting for public sector bodies, insolvency practitioners, large and SME corporations and individuals. Ana strives to give commercial advice whilst guiding clients towards the most cost-effective and pragmatic outcome.

Experience

  • Restructuring/Insolvency: Ana has advised SMEs, large organisations and directors in respect of financial distress situations, personal guarantees and the consequences of insolvency. She has also advised Insolvency Practitioners and Official Receivers in respect of a variety of issues which arise in the context of corporate and personal insolvency, including statutory demands, bankruptcy petitions, transactions at an undervalue, preferences, transactions defrauding creditors, breach of director's duties and misfeasance.
  • IT Contracts/Procurement: most recently Ana worked as part of the team advising the Foreign, Commonwealth Development Office (FCDO) and British Council in the defence of proceedings brought by Vodafone challenging the outcome of FCDO's strategically vital £180 million procurement of technology and communication services for its embassies worldwide. Ana has also advised the FCDO in respect of another IT contract with a number of procurement issues. She has also worked as a part of the a team advising a leading Global IT Solutions Provider in respect of a procurement challenge against an NHS trust, and worked to successfully settle the matter shortly after issue of proceedings. Ana also has experience of advising large and SME companies as well as public bodies in respect of IT contract disputes concerning breach of contract and data/confidentiality issues.
  • Judicial Review Proceedings: Advised a domiciliary care provider following the unlawful termination of its four-year Framework Agreement with a Local Authority worth £5 million. She worked with leading Counsel and advised the client throughout the matter which raised interesting arguments about the overlap between private and public law spheres. Ana a successfully negotiated a settlement for the client which included reinstatement of the Framework Agreement. Ana has also acted for a client brought into Judicial Review proceedings as an Interested Party by an unsuccessful bidder in a procurement ran by a local authority.
  • Data Access and Privacy: Advising a clearing house in respect of its licensing agreements with a third party and the risks associated with its customers arguing that they could create a database using our client's historical archives. Also advised SMEs in respect of data privacy breaches including through cyber-attacks and employee negligence.
  • Commonwealth Games 2022: Advised the Birmingham Organising Committee (OC) for the 2022 Commonwealth Games during Games time in respect a supply side contract for the provision of goods and services. Also advised the OC in relation to an urgent judicial review claim concerning the its' decision to refuse to accredit an athlete, which was resolved in the OC's favour.
