Andrew Maggs

Andrew Maggs is a London-based principal associate and solicitor advocate who advises on intellectual property law, in particular contentious patent disputes.

He has significant expertise working with a range of technology clients, particularly US corporations active in the telecommunications field, in resolving their disputes in the UK, often as part of broader, multi-jurisdictional action.

Andrew's recent experience includes successfully asserting two of Adaptive Spectrum and Signal Alignment, Inc's patents against British Telecommunications plc's flagship Infinity product in the High Court and the Court of Appeal, and resisting BT's application for leave to appeal to the Supreme Court. His work on the case included extensive work preparing technical arguments in conjunction with experts and barristers, and advising on tactical and legal considerations.

Andrew also has substantial experience of litigating Standards-Essential Patents, including advising InterDigital Technology Corporation in its dispute with Nokia Corporation and Nokia Siemens Networks regarding whether 35 of Nokia's patents were essential to the 3G telecommunications standard; and acting for various members of the MPEG LA patent pool in disputes relating to the infringement of patents within the patent pool.

Andrew helped establish our Guangzhou office and assists clients to resolve their technology disputes in China. In April 2015, Andrew was named by Legal Media Group as a "Rising Star" in Patents.

Experience

  • Patent litigation in the following technical areas: Mobile telecoms (2G, 3G, LTE and other standards); fixed line telecoms (including DSL, DSM, ADSL and VDSL); video compression (MPEG2); aviation; audio mixers; consumer electronics; consumer goods.
  • Successfully enforcing Adaptive Spectrum and Signal Alignment, Inc's patents relating to DSL management against British Telecommunications plc's flagship Infinity product in both the High Court and the Court of Appeal.
  • Advising InterDigital Technology Corporation in its dispute with Nokia Corporation and Nokia Siemens Networks regarding whether 35 of Nokia's patents were essential to the 3G telecommunications standard.
  • Acting for Stüder Professional Audio GmbH in relation to the UK aspects of US and UK patent litigation against Calrec Audio Limited relating to the design and functionality of Calrec's audio mixing consoles. The case settled on terms including agreement by Calrec to modify the accused consoles.
  • Advising Dyson in regard to the enforcement of its intellectual property rights in China relating to its revolutionary bladeless fan product.
  • Acting for various members of the MPEG LA patent pool in disputes relating to the infringement of patents within the patent pool.
  • Representing a Chinese white-goods manufacturer when unjustified threats of patent infringement had been made against its UK customers.
  • Arranging for the provision of extensive pan-European pre-action advice, including in relation to the merits of infringement and validity arguments, the relative merits of different European jurisdictions, exhaustion of rights and associated antitrust issues.
  • Assisting a client in reaching settlement in relation to a confidential dispute relating to the assignment of a patent portfolio.
  • Advising a client in relation to a dispute regarding breach of a settlement agreement.
