Clifton P. Prophet

Clifton Prophet is a partner and head of Gowling WLG's Financial Institutions Litigation Group, practising in the areas of insolvency, pensions and employment benefits.

Clifton advises and represents creditors, debtors, insolvency practitioners and other stakeholders in all types of reorganization, liquidation and realization proceedings. Clifton has specialized "nuts and bolts" experience in insolvency disputes.

Clifton also provides advice with respect to pensions and employment issues arising on the purchase and sale of businesses. Other aspects of his advisory practice include acting for the trustees and administrators of pension plans in connection with investment management and custody arrangements, insurance arrangements, plan mergers and transfers, surplus entitlement and the drafting of plan documentation.

Clifton appears on behalf of his clients before the Ontario Superior Court of Justice, the Divisional Court, the Court of Appeal, the Supreme Court of Canada and various administrative tribunals, including the Financial Services Tribunal.

Clifton's experience includes almost two years of practice in London with one of the city's pre-eminent firms. During his time abroad, Clifton advised a range of clients on pensions and employment matters arising on substantial multi-jurisdictional M&A transactions.

Clifton has been a member of the Association of Pension Lawyers (U.K.), the CBAO Pension and Benefits Section Executive and the Legal Advisory Committee to the Financial Services Commission of Ontario.

Clifton is qualified as a solicitor in England and Wales.

Clifton has been a contributor to a number of publications, including Tolley's Trust Law International, Volume 15, 2001, The Advocate's Quarterly, Pension Planning and the CBAO Pension and Benefits Newsletter.

In addition to his writings, Clifton has been a speaker at various seminars and workshops, including the 2004 Canadian Institute Advanced Insolvency Law Seminar and the 2000 Joint Session of the American Bar Association and the International Pension and Employee Benefit Lawyers Association. Clifton is also a guest lecturer on pensions and insolvency at the University of Western Ontario.
