Phedely Ariste

Phedely Ariste is an associate in Gowling WLG’s Ottawa office. He maintains a broad practice with an emphasis on professional liability, medical defence and commercial litigation. He is fluently bilingual and serves clients in both English and French.
In the professional liability sphere, Phedely regularly acts for physicians, psychologists, physiotherapists and other health care professionals in regulatory proceedings and civil litigation matters. His commercial litigation practice includes acting for individuals, corporations, public sector clients, telecommunications companies and not-for-profit organizations of all sizes in a wide range of commercial disputes. Phedely also regularly leads sports investigations and advises on a broad range of sports law matters.
Phedely has appeared as counsel before the Ontario Superior Court of Justice, the Ontario Divisional Court, the Federal Court of Canada, the Ontario Small Claims Court and the Alberta Court of King’s Bench. He has represented clients in commercial arbitrations and appeared before numerous administrative tribunals, including the Health Professions Appeal and Review Board, the Human Rights Tribunal of Ontario, the Social Benefits Tribunal, the Canadian Radio-television and Telecommunications Commission, the Sport Dispute Resolution Centre of Canada and several health Colleges in Ontario and Alberta.
Phedely received his law degree from the University of Ottawa, where he graduated Magna Cum Laude. He completed his degree in the dual Juris Doctor and Political Science program. He was a member of the Dean's Honour List for academic excellence and was the graduating recipient of the Common Law Section Dean's Award in recognition of his significant contributions to the law school community.
Phedely also has proven experience in the political and public policy arena. As part of his practice, he advises and assists clients with government relations and regulatory matters. His background includes working on Parliament Hill for the Independent Senators Group, where he conducted strategic reviews of bills and reports tabled before Parliament and advised senators on a broad range of policy and legislative issues.
During his studies, Phedely served as a senior editor of the Ottawa Law Review and as a teaching assistant in both Constitutional Law and Alternative Dispute Resolution. He was selected to complete a legal internship at a full-service community legal clinic in Cape Town, South Africa and competed in the Charles Rousseau Moot Court Competition in Public International Law in France.
Phedely is the author of the chapters on Rule 68 (Proceedings for Judicial Review) as well as Section 126 of the Courts of Justice Act (Bilingual Proceedings) in Civil Procedure and Practice in Ontario (CPPO), a comprehensive guide written by leading litigators and legal experts in Ontario civil procedure. He remains actively involved in the community and in various mentorship initiatives. He currently serves on the Boards of Directors of the Ottawa Community Housing Foundation and the Association des juristes d’expression française de l’Ontario. He previously served on the Board of the Parliamentary Centre, Canada’s global leader for democracy.
