Evan Atwood is counsel in Gowling WLG's Toronto office. His practice concentrates on dealing with complex issues in regulatory law in various fields, ranging from nuclear to pharmaceuticals, medical devices, food law, and the regulation of cosmetics.
In the nuclear area, Evan has considerable experience helping clients with difficult areas of regulation. He has assisted clients in the regulatory aspects of nuclear project and program development, finance, licensing and compliance, and dispute resolution. In particular, Evan has a great deal of experience in guiding clients through the complex issues raised by the cross-border transmission of information concerning nuclear technology, and with helping clients to deal successfully with inadvertent breaches of Canada's nuclear import and export regimes. In addition, Evan has assisted clients with licensing of nuclear devices and equipment, and in decommissioning of nuclear facilities.
In the area of healthcare products, Evan has considerable experience working with clients in product development. He has guided clients from the pre-licensing phase (including the legal, regulatory, and ethical issues involved in clinical trials) through the licensing phase (involving negotiations with Health Canada and dealing with provincial drug benefit formulary matters), and into the marketing phase (requiring knowledge of industry association codes of marketing, such as IMC; advertising compliance issues involving Health Canada and PAAB; and reporting obligations to Health Canada and PMPRB).
Evan also helps healthcare product manufacturers and other healthcare organizations, both public and private, in dealing with the regulatory aspects of their interactions with healthcare professionals, including issues concerning conflicts of interest and information privacy.
Evan's experience relating to the regulation of the flow of information includes: conducting and responding to access to information requests and reviews of policies and audits of information practices in the nuclear and healthcare sectors, as well as analysis of the use of information between organizations, manufacturers, and government agencies in Canada and abroad.
In addition, Evan has extensive experience working with clients in dealing with reporting to regulators, product recalls, and disputes between companies.
