Emilie Feil-Fraser is an experienced IP litigator, IP strategist, and trademark agent based in Gowling WLG’s Vancouver office.
Her litigation practice encompasses all areas of contentious IP, including copyright infringement, trademark infringement and expungement, passing off, patent infringement and invalidity, and breaches of trade secrets or confidential information. Emilie’s approach to solving disputes emphasizes efficient and effective resolution, engaging alternative dispute resolution processes where practicable. She has appeared before the British Columbia Supreme Court, British Columbia Court of Appeal, Federal Court, and Federal Court of Appeal.
As an IP strategist, she helps clients develop, protect, and leverage the value of IP assets. Her support includes obtaining relevant IP registrations, advising on infringement monitoring and enforcement, and assisting with related commercial agreements. As a registered Canadian trademark agent, she offers in-depth brand strategy advice and handles all levels of trademark prosecution from brand development through to registration. She also coordinates and manages global trademark portfolios for Canadian businesses.
Emilie represents a wide variety of clients — from start-ups to multi-national corporations, across industries such as food and beverage, hospitality, alcoholic beverages, software and technology, clothing and consumer packaged goods, natural health products, manufacturing and fabrication, and entertainment. She has particular experience in the cannabis industry, assisting licensed producers, retailers, and cannabis-adjacent businesses with complex regulatory, advertising, and IP matters.
