Warren P. Foley

Warren Foley is a partner in Gowling WLG’s Calgary office. His litigation practice focuses on bringing a tenacious, pragmatic and efficient approach to construction and energy disputes.

Clients value Warren for his deep understanding of construction and energy industry dynamics and corporate/commercial litigation. His work encompasses all matters of arbitration and litigation, advising both public and private businesses on infrastructure disputes, professional liability defence, shareholder disputes, oil and gas disputes, public-private partnership contracts, large property and construction claims.

Warren has significant experience dealing with disputes arising from large-scale construction and engineering projects in the infrastructure, industrial and commercial sectors. In the context of these disputes, he acts for owners, designers, contractors, subcontractors and insurers. His extensive practice entails:

• Disputes involving critical path delay and productivity loss.
• Cost overrun claims.
• Negligent/faulty design and workmanship claims.
• Contract interpretation disputes.

In addition, Warren routinely advises clients in the upstream and midstream areas of the oil and gas sector, including exploration and production companies, operators, joint venture partners, facility and pipeline owners. His experience includes:

• Management and resolution of oil and gas operational disputes including with respect to fracking operations and gas processing plants.
• Disputes arising from joint venture partnerships, farm out agreements and royalty agreements.
• Joint venture accounting and audit disputes.
• Pipeline ruptures and oil sands construction issues.

Throughout his legal career, Warren has acted for both Canadian and international companies on a variety of multi-million-dollar disputes. In addition, he regularly provides advice to many of his commercial clients with respect to contract drafting and negotiation, corporate strategy and contract disputes.

Warren has appeared in the Alberta Court of Justice, the Alberta Court of King’s Bench and the Alberta Court of Appeal. He is also familiar with all aspects of dispute resolution, including judicial dispute resolution conferences, private mediations and arbitrations. In particular, Warren has substantial experience conducting arbitrations under a variety of procedural rules.  Warren serves as a board member of the ADR Institute of Canada.
